1. About this Policy — Aftershoot Inc. respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal data when you visit Photon websites, use the Photon by Aftershoot desktop application, use AI Style or AI Coach, communicate with us, or otherwise interact with Photon.
2. Photon’s photo-processing approach — Many editing functions run locally on your computer. Photos used only with offline editing functions stay on your device. For AI Style and AI Coach, selected photos are uploaded solely to provide the feature you request, processed transiently, and not retained after processing. We do not use these photos to train general-purpose or shared AI models.
3. Personal data we collect — We may collect account and contact details, communications and support information, transaction and billing information where applicable, marketing preferences, device and technical data, product usage data, diagnostics and crash data, website and cookie data, and limited information from sign-in providers, platforms, analytics partners, payment providers, social platforms, event partners, and publicly available sources.
4. How we use personal data — We use personal data to provide, operate, authenticate, maintain, secure, support, and improve Photon; process AI Style and AI Coach requests; manage accounts; communicate with you; prevent abuse; comply with law; and administer future paid offerings.
5. Legal bases for processing — Depending on the context, we rely on contract, legitimate interests, consent, legal obligations, vital interests, or legal claims.
6. When we disclose personal data — We do not sell your photos. We may disclose personal data to authorised service providers, Aftershoot affiliates, integration partners you enable, authorities where legally required, parties involved in corporate transactions, and recipients at your direction or with your consent.
7. Cookies, analytics, and advertising — Photon websites may use cookies and similar technologies to operate the site, remember preferences, measure performance, and understand traffic. We do not sell personal data or share personal data for cross-context behavioural advertising, and we do not use desktop analytics for targeted advertising.
8. Marketing choices — You can opt out of promotional email using the unsubscribe link or by contacting us. We may still send non-promotional account, security, support, transaction, and service communications.
9. Data retention — We retain personal data only as long as reasonably necessary for the purposes described in this Policy. Photos uploaded for AI Style or AI Coach, associated metadata, derived representations, and recoverable copies are not retained after processing.
10. Security — We use reasonable administrative, technical, and organisational safeguards. No system is completely secure; please protect your device, backups, and account credentials.
11. International transfers — Personal data may be processed in countries whose laws differ from those where you live. Where required, we use appropriate legal transfer mechanisms and safeguards.
12. Your privacy rights — Depending on where you live, you may have rights to access, correct, delete, restrict, object, withdraw consent, receive portable data, opt out where applicable, appeal decisions, nominate another person, and complain to a regulator. 13. Additional information for California residents — We do not sell personal information or share it for cross-context behavioural advertising as those terms are defined under California law.

15. Additional information for India — Where applicable, you may have rights to obtain processing information, correct, complete, update, or erase personal data, access grievance redressal, and nominate another person.
16. Children’s privacy — Photon is not directed to children under 18.
17. Third-party services — Photon may link to third-party services governed by their own privacy practices.
